SimplyConvert Privacy Policy

Privacy and Data Protection Policy Effective Date: This Privacy and Data Protection Policy was last revised on December 27, 2023. 

You have arrived at a SimplyConvert product that is owned and/or operated by SimplyConvert. Our office is located at 210 S. Main Street, Edwardsville IL 62025.

What is SimplyConvert?

SimplyConvert LLC, the law firms that utilize this platform and its affiliates (collectively, “SimplyConvert”, “us”, “we”, or “our”) operate SimplyConvert Plaintiff Database tools, including client portals, Dashboards, a chatbot and embedded forms powered by artificial intelligence. We refer to these as “SimplyConvert”.

The purpose of this Privacy and Data Protection Policy (this “Policy”) is to explain how, when and why we collect and use Personal Data (also referred to as Personal Information), including: 

  • When you utilize the SimplyConvert system via a chatbot or embedded forms regardless of how you access or use the SimplyConvert Dashboard, chatbot or embedded form - whether via personal computers, mobile devices or other smart devices;  
  • When you, as a referral lawyer, receive or send client data through the SimplyConvert platform;
  • When you, as a lawyer, upload (or integrate via an API) client data to SimplyConvert for client acquisition, dual representation tracking, completion of fact sheets, filing of forms, use of client portal or any other purpose that results in placing data on SimplyConvert;

Particularly after client acquisition, we may possess Personal Data about you or your client (“You”) that we did not collect from you. For example, if you hired a lawyer, who then utilizes SimplyConvert to monitor dual representation, we may come into receipt of your Personal Data. In these instances, we encourage you also to check the privacy policies of the third parties that assisted you prior to SimplyConvert. 

This Policy is not intended to override the any rights you are afforded under applicable privacy and data protection laws. 

SimplyConvert assists lawyers evaluate your data to determine qualification in a particular litigation.  We also assist lawyers in maintaining your data for real-time analysis to assist in the resolution of your claim and the claims of others.  Each time you use SimplyConvert, the current version of this privacy policy will apply.  If you do not agree to this privacy policy, please do not use any of our services/platforms.

What Personal Data Do We Collect? 

When we use the terms Personal Data or Personal Information, we generally mean any information that is about or can identify you and which is protected by applicable law. Importantly, de-identified information, statistics/averages/reports based on aggregate information does not constitute Personal Data or Personal Information (for example, the number of clients in a particular mass tort litigation is aggregate information that does not reveal who those users are and is not Personal Data). 

Plaintiff/Claimant

In order to determine qualification of a lawsuit or assist your lawyer with additional steps needed to move your claim towards resolution, we need to collect and process Personal Data about you. If you do not provide the information we need, we may not be able to evaluate your qualification for the legal claim or assist you in moving forward with your claim.

Individual details Name, address, phone number, email, gender, marital status, date of birth, nationality, bank account details, vehicle details, relevant criminal convictions and offenses, employer, job title and family details, including their relationship to you. 
Identification details Identification numbers issued by government bodies or agencies, including your drivers license number, social security number, and military service number.
Session data IP address, channel, source, type of device, URL, operating system, API and other details about how your data was obtained by SimplyConvert. 
Medical information Medical records, medical bills, insurance and Medicare / Medicaid, diagnostic test results, and hospital records.
Lawsuit information

Information about previous and current lawsuits, witness statements, proof of use of products / drug / device and other data.

CATEGORY TYPES OF DATA COLLECTED
Law firm information Name of law firm, address of law firm, law firm phone number, and law firm general email where clients can reach you.
Lawyer, paralegal or other user information Name, phone number and email of at least one lawyer who can be reached by clients, pursuant to ABA Ethics Opinion 506, all other users must provide at least email, but optionally provide cell phone number.
Account and billing data Name, phone number and email of billing contact, credit card information if this is chosen method of payment. 

 

When Do We Collect Your Personal Data?

  1. Plaintiffs/Claimant: We will collect your Personal Data: (1) directly from you when you complete our “Instant Case Evaluator”; (2) from your lawyer through an upload or API integration; (3) from third parties, such as marketing/advertising firm or officers of the court.  
  2. Law firm/other user of SimplyConvert Dashboard: We will collect your Personal Data: (1) when you sign up to utilize a SimplyConvert service; (2) when a referring attorney sign you up to receive cases. 

How Do We Use the Personal Data Collected?

SimplyConvert does not sell, trade, or rent personal information provided by you or by your lawyer/referral lawyer for direct marketing or any other purpose, except as provided in this privacy policy or with your permission.  

  1. Plaintiffs/Claimant – in order to provide you an Instant Case Evaluation, or in order to move you litigation forward, we may use your Personal Data:
    1. With the law firm and referring attorneys who represent you.  Note that SimplyConvert does not control the individuals who are provided access to your data on the Dashboard, this is controlled by your lawyer(s).
    2. To provide you with information about qualification for a lawsuit.
    3. To manage and administer any part of a mass tort litigation.
    4. For direct marketing purposes
    5. To improve our platform and services, to carry out market research, to perform data analytics, for general risk modeling purposes, for company sales and reorganizations, and for statistical analysis.
    6. As necessary to comply with a legal process (such as a court order, subpoena, search warrant, or court filings) or other legal requirement of any governmental authority.  
    7. As necessary to enforce this privacy policy or any of our other terms/conditions.

  2. Law firm/other user of SimplyConvert Dashboard – SimplyConvert requires law firms to provide data about the firm during initial sign up.  We may utilize this data:
    1. To manage our relationship with you;
    2. To improve SimplyConvert and our services, to customize your experience on SimplyConvert or to serve you specific content that is relevant to you;
    3. For internal business purposes, including to help us understand how SimplyConvert is navigated.
    4. To provide you with information about us which we may be required to send you;
    5. For direct marketing purposes
    6. As necessary to comply with a legal process (such as a court order, subpoena, search warrant, or court filings) or other legal requirement of any governmental authority. 
    7. As necessary to enforce this privacy policy or any of our other terms/conditions.
    8. To other law firms/lawyers who are interested in referring lawsuits to you or your law firm.  

How and When Do We Disclose Personal Data to Third Parties? 

In addition, we may share with third parties the information we have collected about you, including Personal Data, to provide our services and comply with our legal obligations. We do not share Personal Data with third parties for their direct marketing purposes. 

The third parties we may share Personal Data with include:

  • Affiliates. We may share your Personal Data with other companies related to SimplyConvert to assist in the delivery of services to you. We also reserve the right to disclose and transfer such information: (1) to a subsequent owner, co-owner or operator of SimplyConvert; or (2) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.
  • Third Party Intermediaries. We may disclose your Personal Data to integrated platforms such as a case management system or medical retrieval company, as needed to move your claim forward.
  • Third Parties. We may use third party vendors in and outside of SimplyConvert’s related entities to perform certain services on our behalf, such as technical support and back-office services, client outreach specialists, medical retrieval company, the press who is interested in the litigation, subject matter specialists, hosting services and SimplyConvert Dashboard activity tracking and analytics.  We may also disclose your Personal Data to our advisors (e.g., attorneys and other professional services firms) in and outside of SimplyConvert’s related entities.
  • Judicial, Regulatory and Law Enforcement Bodies. We may disclose your Personal Data to judicial, regulatory and law enforcement bodies, including, but not limited to: (1) satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such disclosure is required or permitted by law; (2) protect and/or defend our rights, property and/or interests (including, SimplyConvert’s Terms and Conditions of Use or other policies applicable to SimplyConvert) and investigation of potential violations thereof; (3) protect the safety, rights, property or security of SimplyConvert or any third party where we are legally required or advised to do so; and (4) detect, prevent or otherwise address fraud, security or technical issues. Further, we may use information or device identifiers to identify users, on our own or in cooperation with third parties and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion and subject to applicable law. Such disclosures may be carried out without notice to you. 

Ads and Information About You

In accordance with our Cookie Policy, data about your online activity may be collected on SimplyConvert to, among other things: (1) help deliver advertisements to you that you might be interested in; (2) prevent you from seeing the same advertisements too many times; and (3) understand the usefulness to you of the advertisements that have been delivered to you. Note that any images (or any other parts of content) served by third parties in association with third-party ads or other content may act as web beacons, which enable third parties to carry out the previously described activities.

Cookies

SimplyConvert users are able to reject any or all of the cookies and other tracking technologies utilized on SimplyConvert at any time. Our Cookie Policy provides additional details and explains how you can limit the collection of this information.

Do Not Track Disclosures 

Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party website or online services (i.e. cross-contextual behavioral advertising). 

You can opt-out of being targeted by certain third party advertising companies online by visiting the Network Advertising Initiative, Omniture, PrivacyChoice, and/or Digital Advertising Alliance.
We currently do not respond to "Do Not Track" browser signals. Accordingly, your navigation on our sites and services may be tracked as part of our efforts to gather user information described above. If you arrive at our sites and services by way of a link from a third-party site that does respond to “Do Not Track” browser signals, such “Do Not Track” browser signal recognition will end as soon as you reach our sites and services.

Does SimplyConvert Include Third-Party Content and Links to Third-Party Websites? 

SimplyConvert may contain content that is supplied by a third party, and those third parties may collect usage information and your device identifier when webpages from the Website are served to you. The SimplyConvert Dashboard may contain links to third parties. We are not responsible for the data collection and privacy practices employed by any of these third parties on their websites. We encourage you to review their privacy policies and our Terms and Conditions of Use.

How Do I Change My Information and Communications Preferences?

If you wish to update or correct your Personal Data, please email our Data Protection Officer at: info@SimplyConvert.com.  You may stop or modify the email marketing communications you receive from us by following the instructions contained in our promotional emails or in some cases by logging into the SimplyConvert Dashboard and changing your communication preferences. This will not affect subsequent subscriptions and you may limit your opt-out to certain types of emails. 

Please note that we reserve the right to send you certain communications relating to your account or use of the SimplyConvert, such as administrative and service-related announcements, and you will continue to receive these transactional communications if you opt-out from receiving marketing communications.

California Consumer Privacy Act Disclosure

This Section provides additional information for California residents pursuant to the CCPA and applies to Personal Information, whether collected online or offline. 

Please request a copy of our current table that sets out generally the categories of Personal Information about California residents that we have collected in the last 12 months and have disclosed to others for a business purpose. Note that the categories in our table are defined by California state law. Inclusion of a category in the list below indicates only that, depending on the services and products we provide you, we may collect or disclose some information within that category. It does not necessarily mean that we collect or disclose all information listed in a particular category for all our customers, nor does it necessarily mean that the CCPA and other U.S. state law applies to that data. For example, Personal Information that is governed by the federal Gramm-Leach-Bliley Act (GLBA) or Fair Credit Reporting Act (FCRA) is exempted from the CCPA.

How can I review, correct, delete, transfer, or receive a copy of my information or withdraw my consent to process my information?

If you have requested assistance by submitting your information to our platform/sites, you may, at any time, make changes as noted below to that consent –

  • Access the data you provided to us at any time by sending an email that states “transcript” to info@simplyconvert.com
  • The right to opt out of future emails simply by replying “unsubscribe” to any email.
  • The right to opt out of future texts simply by replying “stop” to any text.
  • The right to be forgotten by sending an email that states “delete” to info@simplyconvert.com

Furthermore, by checking the box above the “Get Results Now” button, you have acknowledged that your personal data would be processed and transmitted in accordance with the GDPR and that you have consented to this privacy policy and the Terms & Conditions of use.

Please note that, pursuant to the General Data Protection Regulation (GDPR), if you are located in the European Economic Area, you have the right to file a complaint with the relevant supervisory authority if you believe we have not been able to assist you with your inquiry.

How does SimplyConvert keep my information secure?

We use security measures designed to protect against the loss, misuse and alteration of the information under our control. Transcripts are stored, maintained and archived on secure, hardened servers that are hosted on highly secure data centers. Access to this data is protected by multiple layers of controls including firewalls, role-based access controls, authentication mechanisms and monitoring. Data is backed up, and archives are stored off-site in a secure location.

Please note that we do not make any assurances as to the security of your information in the hands of our affiliated lawyers.

Additional Mobile Considerations

In addition to the other terms in this policy, if you engage with our sites/plaforms in a mobile application, we may receive information about your mobile device, including a unique identifier for your device.

If you receive SMS messages from SimplyConvert, you may opt out by replying “Stop” at anytime.

If you receive SMS messages from one of our affiliated law firms, you may opt out by following the opt-out instructions provided by that law firm. You may also contact us at info@simplyconvert.com, and we can help put you in touch with the law firm regarding your request.

Children

SimplyConvert sites/platforms are not directed to individuals under 18. If you are under the age of 18, you may not use our platform without a valid parental or legal guardian consent. SimplyConvert does not knowingly collect personal information from individuals under the age of 18. If you are a parent of an individual under 18 and believe your child has provided information to SimplyConvert, or if you are a California resident under the age of 18 and wish to remove content you have made publicly available, please contact us at info@simplyconvert.com, where you may request to exercise your applicable access, rectification, cancellation and or objection rights. SimplyConvert reserves the right to immediately delete the information of any individual, to the extent permitted by law, who it believes is under the age of 18.

Miscellaneous

We recommend that you review this privacy policy periodically, as we may update it from time to time. Your use of our sites/platforms, as applicable, constitutes your consent to the new privacy policy to the fullest extent permitted by law.

We are not responsible for and do not control the privacy practices of any of our affiliated law firms or third-party partners. We encourage you to review the privacy practices of these other parties.
